Basic Questions and Answers Regarding Your Rights with the Nigerian Police

Nnamdi Christopher Iroaganachi

  1. The question to ask is: is the police allowed to conduct a search on you or on your premises?
  2. Does the Police require a warrant to do so?
  3. What are your rights in the event that a police search is conducted with or without a warrant?
  4. ‘I know my rights’ but then what? How should you conduct yourself in this scenario?

ANSWER TO QUESTION 1

On the 4th of September, 2018 policemen raided the residence of Chief Edwin Clark, a former politician and elder statesman on the suspicion that he was hiding weapons.

Is the police allowed to conduct such a raid? It is on record that the police did not obtain a warrant to conduct this raid. Under the old law called the Criminal Procedure Act, the Police were allowed to conduct arrests without a warrant. The new law passed in 2015 called the Administration of Justice Act 2015 makes it clear that the Police can no longer effect an arrest unless a warrant of arrest is produced.

ANSWER TO QUESTION 3

According to this current piece of legislation, the Police no longer have the power to arrest any persons in lieu of the suspect(s). Under the old law, the Police were not required to give a suspect any reason for their arrest but this has changed with Section 6 of the ACJ Act providing that an arrested suspect must be furnished with information regarding their arrest.

It is the constitutional duty of the police to inform the suspect that they possess a right to remain silent and that this right extends to protect them from writing any statement, endorsing any document or statement until they have consulted with a legal practitioner or anybody whom they choose to consult.

Furthermore, the police have a constitutional duty to inform the suspect that they may seek recourse to legal representation from the Legal Aid Council of Nigeria if they so desire.

This new law also mandates whichever authority exercising custodial power to inform the next-of-kin of the suspect without charge to the suspect.

ANSWER TO QUESTION 4

It is true that the Act provides for the police to treat the suspect in a humane and dignified manner in accordance with Section 34 of the Constitution, common sense also imposes an expectation that the suspect should act in a manner that is not unduly confrontational. The Act states that the suspect is to be brought to trial within a reasonable time or released on bail with or without conditions attached.

Under Section 15 of the Act. Required Inventory of Property: If You are arrested you must know that it is your right to insist that the police should take a record of all the property found on you.

The police officer and the arrested suspect must sign that document which lists out all the items found on the suspect. The list or record will still be valid if the suspect refuses to sign that document.

Section 15 (2) provides that the process of recording the arrest must be within a reasonable time and must not exceed 24 hours. Section 15(4) further states that if the suspect Volunteers to offer a confessional statement then it may be in writing or recorded electronically or digitally to a retrievable video compact disc or other such audio-visual technology.

But if the following is not available then even the oral statement of the suspect is admissible in court. Section 17 reinforces the provision of Section 17 of the old law that the confessional statement should be made in the presence of the suspect’s legal practitioner or anybody of his choice.

The Act also makes it mandatory for the Inspector-General of Police and every entity authorised by law to make arrests to submit a record of all arrested suspects to the Attorney-General of the Federation every quarter. This same provision applies to the state Commissioner of Police of each state who is to submit the same to the state A-G.

The information which is required to be submitted are: the complete particulars of the suspect arrested including the alleged offence, the date when the arrest was made, complete name of the suspect, the suspect’s occupation, address, height, photograph and fingerprint of such a suspect.

Section 29 (5) provides that the Attorney-General is to maintain an electronic and manual database of all arrested suspects within states and Federally.

OUR LADY OF FATIMA CATHOLIC HOSPITAL, AGUDA

Our lady of Fatima Catholic Church Aguda is an established Parish that has existed for over forty years and the grace with which God has blessed the Parish with fantastic and dynamic priests, religious  and other servants of God over the years. The parish has been able to gather very large dedicated parishioners resulting to Tens of Thousands of Catholic faithful.

The resultant effect is that a parish and two outstations such as St. Pio Catholic Church Iganmu, Our Lady Queen of Apostles Kilo and Our Lady Queen of the Most Holy Rosary Sanya were all given birth to by Our Lady of Fatima Catholic Church.

As with human nature, the parishioners have grown in number that we have such large gatherings on Sundays so much that seven masses are usually celebrated. Therefore, there is the need to pay attention to some human need such as health and medical services. At a glance this might not appear so clear as people might imagine that all that is expected of us is to visit the church; say our prayers, attend devotions and masses and return back home, but if viewed critically and need carefully examined, the following facts can be seen;

The urgent need to tap on the availability of the abundant human resources the parish is blessed with such as medical doctors, nurses, dentists, lab scientists, physiotherapist, surgeons, et-al, who want to volunteer their services to see that parishioners, and those within the environs who need medical services are well taken care of.

Furthermore, the parish has been organizing Health week over the years but the personnel and space available for this exercise is largely inadequate when compared to the demand and number of people who attend the week long free health consultation, treatment and distribution of drugs.

Therefore, it will not be out of place to provide a more suitable and comfortable place to address their health issues which the present clinic cannot cope with.

For all these and many more reasons that cannot be enumerated here, the parish has decided to pull down the existing structure presently situated at No. 37 Adetayo Shode Street, Aguda and in its place, construct a modern Clinic befitting of the size and people that constitute OLF.

In view of the above, we humbly appeal to you our dear parishioners, friends and well wishers to kindly support this noble course which will be of immense benefit to all of us.

All generous donors and contributors should direct their kind support in cheque or cash to Our Lady of Fatima Catholic Church Aguda.

May God continue to keep, watch and bless our families.

Amen.

Why am I silent?

Every day in Nigeria over 2,739 babies are killed in abortion. As the babies are killed they cry and scream but nobody hears them, because they are being killed inside their mother’s womb.

Their scream is a Silent Scream. Today I’m silent because I want to scream with them to make people aware that many babies are being silenced forever by abortion. I’m silent because I want to be a voice for the voiceless, the countless unborn innocent children who are being silenced daily in hospitals all over Nigeria.

They’re not given a chance to be heard. They’re not given a chance to be seen alive. They are not given a chance to be loved. .They’re not given a chance to live.

When does  life begin:
Life begins at conception or fertilization when a man’s sperm unites with a woman’s egg in the fallopian tube. At this moment, all the necessary elements that create a human life are present It is only the human life that is made in the image of God. It is this sharing of life with a God who is sacred that made our life sacred

So why do women have abortions?
Most women -- at least 70% -- say they believe abortion is immoral. But they choose against their conscience because of pressure from others and their circumstances. More than 80% say they would have completed their pregnancies under better circumstances or with more support from the people they love.
Abortion is not a true "choice" on the woman's part; it is an act of despair. On a very basic level, it is precisely because women who abort are acting against their consciences and their maternal instincts that the psychological impact of abortion is so profound.
So what are the psychological after effects of abortion?
Every woman is different. They have different responses that may appear in a different period. Some women repress or are unaware of any after effects for years. Many reactions are delayed but are triggered later by significant events such as the birth of a child, the death of a loved one or the end of a relationship, or a religious conversion. Commonly reported reactions include: feelings of guilt, shame, anxiety, helplessness, depression, abuse of substance, grief and/or remorse
So what's the way out
We should refrain from sexual relations outside marriage, or if married, we should use periodic abstinence or Natural Family Planning in order to avoid pregnancy, rather than to risk a pregnancy with the intention of having an abortion if it occurs. Sexual intimacies outside marriage are wrong. A man who loves a woman will discipline himself likewise. If both yield to temptation, then love requires that, they share the responsibility in every way.
